Social Security

Social Security is a lifeline for millions. That’s why VPLC is helping Virginians navigate the system and fight for a stronger, more accessible safety net.

We’re advocating for better access, clearer processes, and protections that ensure every Virginian receives the benefits they’re owed. This includes fighting for timely decisions, fair hearings, and outreach that reaches vulnerable populations such as seniors, people with disabilities, and those facing language or technology barriers. Everyone who qualifies for Social Security benefits deserves a system that works for them.

Our work in this area includes:

Fixing the Social Security Overpayment Crisis

VPLC is pushing for systemic reform to prevent beneficiaries from being unfairly penalized for agency errors. We support proposed federal rule changes that would:

  • Stop automatic and unaffordable recoupments of overpayments.
  • Require Social Security to demonstrate fault before seeking repayment.
  • Ensure overpayment notices are understandable and accessible.
  • Protect low-income recipients from being driven deeper into poverty due to bureaucratic mistakes.

Helping Virginians Navigate Social Security Disputes

VPLC works with individuals facing overpayment demands and benefit denials to help them understand and assert their rights. Our work includes:

  • Providing legal support to challenge improper benefit decisions.
  • Assisting with appeals and waiver requests.
  • Helping clients gather evidence and communicate with SSA.
  • Sharing stories to highlight the human impact of flawed policies.

Holding Federal Agencies Accountable

Through national coalitions and public comments, VPLC is working to shape federal policies that protect beneficiaries. Recent efforts include:

  • Partnering with groups to spotlight the harm caused by overpayment practices.
  • Submitting formal comments supporting SSA’s proposed 2025 rule change.
  • Advocating for long-term reforms that make the Social Security system more humane and responsive.
  • Elevating client voices to influence change at the national level.

Wanda’s Story

Initially, Wanda had contacted legal aid concerning Supplemental Security Income (SSI) benefits for her children. The attorney also explained the Individual Education Plans (IEP) process. With legal aid’s help, her son began to receive SSI benefits, an IEP plan for him was created and implemented, and he received other resources to help him learn.
